Experienced Divorce Attorney in Wichita Helps Families in Transition

Giving detailed divorce guidance to residents of Kansas and Sedgwick County

Few people know what to expect from a divorce, and the legal process can be intimidating. The stakes are high when you are making choices that could impact your children and financial security, so it’s wise to proceed with caution. I am Cindy L. Cleous, and my firm Cindy L. Cleous, L.L.C. has been guiding clients through this process for more than 30 years.

Assisting clients with the Kansas divorce filing requirements

Kansas allows both no-fault and limited fault-based grounds for divorce. The simplest method is a no-fault divorce, where you can simply state that “the parties are incompatible” in order to pursue a dissolution. However, you also have the option to choose among two grounds for divorce — failure to perform an obligation/material marital duty or incompatibility due to mental incapacity or mental illness.

To get divorced in Kansas, one spouse must have been a resident of the state for at least 60 days before filing a petition to end the marriage. There is also a 60-day waiting period before the court will grant a final divorce decree. Whether your divorce alleges fault or not, my firm will ensure that your documents are executed and filed properly to give you peace of mind during what can be a stressful process.

Providing strong representation in all matters related to divorce

Both uncontested and contested divorce are possible in Kansas. An uncontested divorce can be pursued when both parties agree on issues regarding property division, custody and support.

If any of these issues can’t be agreed upon, you will have a contested divorce that may involve more mediation, hearings and negotiation. My firm is ready to answer your questions and safeguard your interests with respect to:

  • Child custody — Your ongoing relationship with your children is a priority, and I work hard to help you get the child custody and parenting time schedule that meets the needs of you and is in the best interests of your children, whether that involves you having sole custody, sharing joint custody or some other arrangement.
  • Child support — I will help you negotiate a child support agreement that is fair and considers the true financial situation of both parents. If an agreement can’t be reached, I will litigate the matter in court.
  • Property division — My firm will gather the information needed to properly value assets and represent your interests in the property division area of your divorce.
  • Spousal maintenance — I will help you resolve disputes, either inside or outside the courtroom, related to new or existing spousal maintenance (also known as alimony) orders.

When it comes to family law matters, I understand the need to handle these cases with compassion in order to help you achieve your goals.
