The simplest method is a no-fault divorce, where you can simply state that “the parties are incompatible” in order to pursue a dissolution. However, you also have the option to choose among two grounds for divorce — failure to perform an obligation/material marital duty or incompatibility due to mental incapacity or mental illness.
To get divorced in Kansas, one spouse must have been a resident of the state for at least 60 days before filing a petition to end the marriage. There is also a 60-day waiting period before the court will grant a final divorce decree.
